| 1. I,
, hereby agree to engage the services of ImageChic.com
("IC"), to take possession of the within described item(s) for
the purpose of consignment sale on my behalf.
2. I
("CONSIGNOR" or "I") understand that if the item(s) consigned
are not authentic, I may either have them returned to me
at my expense or opt to have the item(s) destroyed by IC.
3. I
agree that IC will receive sale proceeds exceeding the amount
to be settled with me. The amount agreed upon between IC
and me will be paid to me via check within 30
business days after buyer's payment has cleared.
4. I
understand that IC will recommend an opening or minimum
price at which the item(s) will be listed for sale, but that
this price is negotiable.
5. The fee due to IC for consignment
service is 40% of the selling price, unless another rate
is negotiated in writing.
6. Any and all fees associated with the sale of my items will be deducted
from the sale price, for purposes of determining the amount
that is remitted to seller.
7. I
understand that with respect to the item(s) I am consigning,
IC will not make any agreements with any other party without
my written consent.
8. I
understand that IC will use all reasonable and due care in protecting
the item(s) given for consignment sale.
9. I
understand that IC will photograph, display for sale, safely
package and ship the item(s) being sold and that I shall
not incur any charges in this process. I further understand
that IC shall have the sole discretion as to where the item(s)
will be displayed or advertised for sale.
10. I understand that IC allows layaway sales,
whereby buyers may take up to 60 days to make payment in
full, after a 20% deposit. I will receive payment within 30 days after the
buyer completes payment of the item.
11. I
hereby affirm that the item or items that I submit to you
were obtained legally. I am the owner and I am fully authorized
and entitled to sell the items.
12. I understand
that the item(s) may or may not sell at the agreed upon price
and that I shall hold IC harmless for any time or monies
lost or expended during the listing period. I further understand
that upon written notice to IC, I may opt to have the item(s)
returned to me at my expense, at any time.
13. I understand
that IC will obtain an email acknowledgement from me regarding
any price change(s) prior to making said change(s), in excess
of 20%.
14. I
understand and agree that this contract shall endure until
the item(s) sells or IC or until Consignor terminates it in writing. |
